Copyright and DMCA Policy

Arkenly LLC respects intellectual property rights and responds to notices of claimed copyright infringement under the US Digital Millennium Copyright Act (“DMCA”).

Reporting infringement

Send a written notice to our designated agent (details below) that includes:

1. your physical or electronic signature;
2. the copyrighted work you say is infringed;
3. the page and material you say infringes it, with the link, so we can find it;
4. your name, address, phone number and email;
5. a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law; and
6. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for them.

Counter-notice

If your material was removed and you believe that was a mistake or misidentification, you can send a counter-notice to our agent with:

1. your physical or electronic signature;
2. the material that was removed and where it appeared;
3. a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification;
4. your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the US, any judicial district where Arkenly LLC may be found), and that you'll accept service of process from the person who sent the original notice.

We'll forward the counter-notice to the person who complained. If they don't tell us within 10 business days that they have filed a court action, we may restore the material.

Repeat infringers

We close the accounts of owners who repeatedly infringe others' rights, in appropriate circumstances.

Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly makes a false claim in a notice or counter-notice may be liable for damages.
